DRAFT: counsel must review before launch. This is a starting text written by the product team. It is not legal advice and must be reviewed by a TCPA/FTC lawyer before outside customers rely on it. Bracketed items need a decision.
This Acceptable Use Policy ("AUP") is part of the Sell For Me Terms of Service. It says what you may and may not do with Sell For Me's AI sales reps, calls, texts and emails ("the Service"). "You" means the business that holds the account and everyone it lets use the account.
You are responsible for every call, text and email the Service makes for you, for what you sell, and for the claims your reps make on your behalf.
1. Consent to call and text (TCPA)
1.1. You may only have the Service call or text a person who gave you the consent the law requires for that kind of contact. For calls or texts that use an AI or artificial voice, or an automatic dialing system, to market to a mobile phone, that usually means prior express written consent that names your business, says the person agrees to be called or texted by automated or AI technology, and is not a condition of any purchase.
1.2. You must keep a record of each person's consent (who, when, how, and the exact words they agreed to) for at least [5] years and give it to us within 2 business days when we ask.
1.3. You must follow the federal and state do-not-call rules, calling-hours limits, and state-specific telemarketing laws that apply to each person you contact. The Service applies calling hours, do-not-call lists and some state rules for you, but these tools do not replace your own duty to comply.
2. No purchased or shared lists without consent
2.1. You may not upload, import or call purchased, rented, scraped, shared or "aged" lead lists unless every person on the list gave consent that names your business (not just "partners" or "affiliates") and that consent is still valid.
2.2. You may not use the Service to contact people whose numbers were generated, guessed or collected without their knowledge.
3. Honor every opt-out
3.1. When anyone asks not to be contacted, by any reasonable means ("stop", "take me off your list", "don't call me again", replying STOP, or telling a rep in any words), you must stop contacting them on every channel.
3.2. The Service records opt-outs instantly and blocks further calls and texts on all channels. You may not remove an opt-out, re-import an opted-out person, or contact them through another tool, unless they later give you new consent in writing.
4. No harassment
You may not use the Service to threaten, intimidate, shame, pressure or abuse anyone, to call or text the same person repeatedly with the intent to annoy, to contact people at unreasonable hours, or to use fake urgency, false deadlines or false scarcity to pressure a sale.
5. No illegal or prohibited products
You may not use the Service to sell, promote or collect money for anything illegal where you or the person contacted is located, including: illegal drugs or drug paraphernalia, unlicensed financial, credit-repair, debt-relief or investment services, unregistered securities, "get rich quick" or income schemes, gambling where it is not licensed, weapons where sale is restricted, counterfeit goods, adult services, or anything aimed at minors. [Counsel: confirm the restricted-category list and any categories needing extra review, such as debt relief, health claims, insurance and real estate.]
6. No impersonation or deception
6.1. You may not have the Service pretend to be another business, a government agency, a bank, a carrier, a court, or any person you are not.
6.2. You may not make false or unsupported claims, including income or earnings claims, health or results claims, fake reviews or testimonials, or guarantees you will not honor.
6.3. You must deliver what you sell and give the refunds you owe.
7. AI disclosure
7.1. Your reps are AI. The Service tells each person they are speaking with an AI assistant, and answers truthfully whenever someone asks whether they are talking to a person or a machine.
7.2. You may not instruct, script, prompt or configure a rep to deny being an AI, to claim to be a human, or to hide the disclosure, and you may not try to work around the Service's safety rules (for example the opt-out, crisis, hardship and disclosure rules).
8. People in crisis or financial distress
If someone says they are in crisis, the rep stops selling and gives them the 988 Suicide & Crisis Lifeline, and a person at your business is flagged. If someone says they cannot afford basic needs, the rep does not push a high-ticket sale. You may not change these rules.
9. Recording and privacy
You must give any notice and get any consent the law requires to record calls in the places you call. You may not use the Service to collect or relay payment card numbers by voice or text.
10. Monitoring, suspension and termination
10.1. We monitor use of the Service to keep people safe and to protect our phone numbers and carrier standing. This includes automated and human review of calls, transcripts, texts and account activity. New accounts get closer review and lower daily limits for their first days.
10.2. We may suspend outbound calling and texting, or the whole account, at any time and without notice if we believe you have broken this AUP or the law, if a carrier or regulator asks, or if your opt-out, complaint or chargeback rates are too high. We will tell you why and let you respond. Clear violations (for example impersonation, illegal products or fraud) may lead to immediate termination and a ban from creating new accounts.
10.3. We may report illegal activity to the authorities and share information with carriers, payment processors and regulators as the law allows or requires.
11. Reporting abuse
To report misuse of the Service, email [abuse@sellforme.ai].
12. Changes
We may update this AUP. When we make a material change we publish a new version and you must accept it the next time you sign in before you keep using the Service.
